Applying for Social Security Disability Insurance (SSDI) in New York is a process that requires time, patience, and preparation. One of the most common questions applicants ask is:
“How long does it take to get SSDI benefits in New York?”

Initial Application: 3 to 6 Months

After you submit your SSDI application, the New York Division of Disability Determination Services (DDS) reviews your claim. This stage usually takes 3 to 6 months, depending on:

Note: New York reinstated the reconsideration step in 2019, so this is now part of the appeals process statewide.


Hearing Before an Administrative Law Judge: 9 to 14 Months

If reconsideration results in another denial, you can request a hearing before an Administrative Law Judge (ALJ). In New York, the wait time for a hearing can range from 9 to 14 months, depending on:


  • Your local hearing office’s backlog (e.g., Brooklyn, Buffalo, Albany, etc.)
  • The complexity of your case
  • Whether you are submitting new medical evidence


This is the stage where many applicants are finally approved—but it can take well over a year from your initial filing date.


Appeals Council Review: 6 Months to 1 Year

If you’re denied again by the ALJ, you can request a review by the Appeals Council. This process can take 6 months to a year, and not every request is accepted.


Federal Court: 1 Year or More

The final appeal level is filing a lawsuit in federal district court. This option can take over a year, and legal representation is strongly recommended at this stage.
